Overview
These terms apply to all electrical work carried out by Latham Electrical Pty Ltd. By accepting a quote or instructing us to commence work, the client agrees to the terms set out below.
Scope & Responsibilities
- We will carry out the works described in the accepted quote, in accordance with AS/NZS 3000 and all applicable regulations.
- Work outside the accepted scope will not be carried out without a written variation approved by the client.
- The client is responsible for ensuring that any information provided about the site, including the location of existing services, is accurate.
- We will issue a Certificate of Electrical Safety on completion of all prescribed electrical work.
Payment Terms
- Invoices are payable within 7 days of the invoice date.
- For works exceeding $2,000, a deposit of 20 percent is payable before materials are ordered.
- Accepted payment methods are bank transfer and PayID. Card payments incur a surcharge equal to the merchant fee.
- Overdue accounts accrue interest at 10 percent per annum, calculated daily from the due date.
- Any costs of recovery, including debt collection and legal costs, are payable by the client.
Variations & Extras
- Any additional work requested during the job will be quoted and approved in writing before it is carried out.
- Where a latent condition is discovered that could not reasonably have been identified at the time of quoting, work will pause and a variation will be issued.
- Verbal instructions to proceed with additional work will be confirmed in writing before commencement.
Access & Client Duties
- The client must provide safe, clear and unobstructed access to the work area during agreed working hours.
- The client must advise us of any known asbestos, hazardous materials or life-support equipment on site before work begins.
- Where access is denied or the site is unsafe, we may suspend work and charge for time lost.
Warranty & Compliance
- Workmanship is warranted for 12 months from the date of completion.
- Supplied materials and equipment carry the manufacturer's warranty only.
- The warranty does not cover damage caused by misuse, third-party interference, or works altered by another party.
- Nothing in these terms excludes rights under the Australian Consumer Law.
Insurance
- We hold public liability insurance to the value of $20 million. A certificate of currency is available on request.
Cancellation
- Cancellation with less than 24 hours notice may incur a callout fee equal to one hour of labour.
- Where materials have been ordered specifically for the job, the cost of those materials is payable on cancellation.
Liability & Disputes
- Our liability is limited, to the extent permitted by law, to the resupply of the services or the cost of resupply.
- We are not liable for consequential loss, including loss of income or loss of use.
- In the event of a dispute, both parties agree to attempt resolution in good faith before commencing proceedings.
